What Penske (Penske Truck Leasing / Penske Logistics) has said
This record covers Penske Truck Leasing Co., L.P. and Penske Logistics LLC, the two employers named in Penske's applicant privacy notice and on the job postings we read. We found no fair-chance or second-chance statement from Penske, and it is not on the Second Chance Business Coalition member list. All seven driver, technician, warehouse, customer service and management trainee postings we opened mention a drug screen, and six of them say a background investigation that includes criminal history is required. Penske's CDL driver jobs are also covered by federal FMCSA drug-testing rules.
We didn't find a public statement from Penske (Penske Truck Leasing / Penske Logistics) about hiring people with records: not on its careers site, in its reports, or in its announcements. That doesn't mean it won't hire you. It means there's nothing on the record to point to.
Does Penske (Penske Truck Leasing / Penske Logistics) do background checks?
Penske (Penske Truck Leasing / Penske Logistics) runs background checks. Six of the seven postings we opened (a CDL Class B driver in Jackson, MS; a part-time CDL driver in Los Angeles; a diesel technician and a warehouse forklift operator in Houston; a customer service coordinator in Garland, TX; and a management trainee in Evansville, IN) list a background investigation or screening that includes criminal history as a requirement; most say it also covers past employment and education. The Jackson driver posting also lists a 3-year motor vehicle record requirement, and several postings for roles that drive vehicles describe an annual motor vehicle records check. A part-time CDL driver posting in New York, NY mentioned a drug screen but no background check. Penske's applicant privacy notice (last updated January 1, 2023, covering Penske Truck Leasing Co., L.P. and Penske Logistics LLC) says it collects information from background check providers and runs background and reference checks where applicable, without naming a vendor, lookback period or timing.1,2,3,4,5,6,7,8
Does Penske (Penske Truck Leasing / Penske Logistics) drug test?
Penske (Penske Truck Leasing / Penske Logistics) drug tests for some roles. All seven postings we opened (CDL drivers in Mississippi, California and New York; a diesel technician, a warehouse forklift operator and a customer service coordinator in Texas; a management trainee in Indiana) say a drug screen is required or that the applicant must be able to pass one. Penske's applicant privacy notice says it collects drug screening results and a physical exam depending on the role applied for. Penske hasn't published a testing method or a policy on marijuana. CDL driver jobs are also covered by the federal rule described under role notes.1,2,3,4,5,6,7,8
Rules for specific jobs
- CDL truck drivers
(federal rule) FMCSA says that, generally, all CDL drivers who operate commercial motor vehicles on public roads are subject to DOT drug and alcohol testing, including part-time and backup drivers, and an employer must receive a negative drug test result before letting a CDL driver operate a commercial vehicle.9
- CDL truck drivers (company policy)
Penske's CDL driver postings that we opened say the role is regulated by the Department of Transportation or treated as safety-sensitive, and the Jackson, MS posting requires a 3-year motor vehicle record with two or fewer moving violations or accidents. The Los Angeles and New York part-time postings say CDL holders will have a DOT drug screening within 30 days of start and a review of the FMCSA Drug and Alcohol Clearinghouse; the federal rule above requires a negative result before driving.1
Your rights, and how far back a check can go
- Under the federal Fair Credit Reporting Act (FCRA), an employer must get your written permission before it gets a background report about you from a background screening company.17,18,19
- Before an employer decides not to hire, keep, or promote you because of something in a background report, it must give you a copy of the report and a document called "A Summary of Your Rights Under the Fair Credit Reporting Act."17,18
- You have the right to dispute inaccurate or incomplete information in your background report directly with the company that made it.17,20
- The FCRA's seven-year limit does not apply to criminal convictions, so under federal law a conviction can show up on a background report no matter how old it is.21,22
- Under the FCRA, background and credit reports generally cannot include arrest records, civil lawsuits, or civil judgments that are more than seven years old (or older than the statute of limitations, if that is longer).21,23
Before you apply
- You can ask a background screening company for the information it has on you, and the CFPB keeps a list of consumer reporting companies, including employment screening companies, with their contact details.17,20,24
- According to the Clean Slate Initiative, 14 states and Washington, D.C. have passed Clean Slate laws that meet its criteria for automatically clearing eligible records: Pennsylvania, Utah, New Jersey, Connecticut, Michigan, Delaware, Virginia, California, Oklahoma, Colorado, Minnesota, New York, Illinois, and Missouri, plus D.C.25
- The Federal Bonding Program, run by the U.S. Department of Labor, lets states give employers free fidelity bonds that protect them against losses from a newly hired worker's dishonest acts, for job seekers with past justice involvement or in recovery from substance use.26,27
