Does Jack in the Box hire people with felonies?

No published policy

Unclear.

Jack in the Box hasn't published a policy on hiring people with criminal records.

Jack in the Box's careers site, applicant privacy notice and the postings we opened say nothing about how a record is weighed or about fair-chance hiring, and franchisees make the hiring decisions for the restaurants we saw.

What Jack in the Box has said

Jack in the Box's careers site lists thousands of restaurant jobs, and the restaurant postings we opened say the restaurant is owned and operated by an independent franchisee, not Jack in the Box Inc., and that the franchisee alone is responsible for hiring and other employment matters. Jack in the Box Inc.'s U.S. job applicant privacy notice says it may collect applicant information from background check providers and lists performing background checks as permitted by law among its purposes, but says it doesn't cover applicants to independent franchisees. We found no Jack in the Box statement on hiring people with criminal records, and it is not on the Second Chance Business Coalition member list.

We didn't find a public statement from Jack in the Box about hiring people with records: not on its careers site, in its reports, or in its announcements. That doesn't mean it won't hire you. It means there's nothing on the record to point to.

Does Jack in the Box do background checks?

Jack in the Box runs background checks. Jack in the Box Inc.'s applicant privacy notice (Privacy Notice and Notice at Collection for Job Applicant Data – US) lists reference checks, employment and education verification, work authorization checks and performing background checks as permitted by law among its purposes, and names background check providers as a source and as service providers. It doesn't name criminal history, say which jobs are checked, when, or how results are weighed, and it is framed around California privacy law. It doesn't cover applicants to independent franchise operators, and the franchisee postings we opened say the franchisee sets the job requirements.1,2

Does Jack in the Box drug test?

Rules for specific jobs

  • Restaurant crew and managers at franchisee-owned restaurants

The Jack in the Box restaurant postings we opened (crew in Midlothian, TX and Acton, CA, and a manager in Concord, NC) say the restaurant is owned and operated by an independent franchisee, not Jack in the Box Inc., that the franchisee will be your employer, and that it is responsible for all employment matters including requirements and hiring decisions. Ask that employer about background checks.2

  • Corporate jobs (Jack in the Box Corp., San Diego)

The careers site lists corporate positions with Jack in the Box Corp. as the employer, and the applicant privacy notice lists performing background checks, as permitted by law, among the purposes for applicants to Jack in the Box Inc. and its affiliates. The one corporate posting we opened (Director, Brand Marketing, San Diego) doesn't mention background checks or records.3

Your rights, and how far back a check can go

  • Under the federal Fair Credit Reporting Act (FCRA), an employer must get your written permission before it gets a background report about you from a background screening company.9,10,11
  • Before an employer decides not to hire, keep, or promote you because of something in a background report, it must give you a copy of the report and a document called "A Summary of Your Rights Under the Fair Credit Reporting Act."9,10
  • You have the right to dispute inaccurate or incomplete information in your background report directly with the company that made it.9,12
  • The FCRA's seven-year limit does not apply to criminal convictions, so under federal law a conviction can show up on a background report no matter how old it is.13,14
  • Under the FCRA, background and credit reports generally cannot include arrest records, civil lawsuits, or civil judgments that are more than seven years old (or older than the statute of limitations, if that is longer).13,15

  • The Federal Bonding Program, run by the U.S. Department of Labor, lets states give employers free fidelity bonds that protect them against losses from a newly hired worker's dishonest acts, for job seekers with past justice involvement or in recovery from substance use.18,19
